TERMS OF SERVICE

By creating an account or using CastBank ("the Platform," "we," "us," or "our"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform. We reserve the right to update these terms at any time, with notice provided via email or in-app notification.

CastBank is a casting management platform that connects talent (actors, background performers, stand-ins), crew (directors of photography, gaffers, grips, production assistants), and producers (casting directors, production companies) for film, television, commercial, and other media productions.

The Platform provides tools for posting casting calls, submitting applications, managing bookings, processing payments, and communicating between production professionals.

You must be at least 18 years of age to create an account. By registering, you represent and warrant that:

• All registration information you provide is accurate and current
• You will maintain the accuracy of such information
• You are legally permitted to enter into these Terms in your jurisdiction
• You will not share your account credentials with any third party

CastBank reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misrepresent professional credentials.

CastBank offers paid subscription plans for talent and crew members at $3.99/month. Producer accounts are free. Subscriptions are billed monthly and renew automatically unless cancelled.

• All payments are processed securely through Stripe
• Subscriptions can be paused or cancelled at any time from your account settings
• Cancellation takes effect at the end of the current billing period; access continues until that date
• Pausing a subscription suspends future billing while retaining your account and profile data
• Prices are subject to change with 30 days' notice

No Refund Policy

All subscription fees paid to CastBank are strictly non-refundable. CastBank does not issue refunds, credits, or chargebacks for any reason, including but not limited to:

• Partial or unused subscription periods
• Accidental purchases or automatic renewals
• Dissatisfaction with the Platform or its features
• Account suspension or termination due to violations of these Terms
• Technical issues, downtime, or service interruptions

If you no longer wish to be charged, you must cancel or pause your subscription before the next renewal date. By subscribing, you expressly acknowledge and agree to this no-refund policy. Your only remedy for dissatisfaction with the Platform is to cancel or pause your subscription.

You retain ownership of content you upload to CastBank (headshots, demo reels, portfolios). By uploading content, you grant CastBank a non-exclusive, royalty-free license to display and distribute that content on the Platform for the purpose of facilitating casting connections.

You agree NOT to:

• Post false, misleading, or fraudulent casting calls or profiles
• Harass, threaten, or discriminate against other users
• Use the Platform for any unlawful purpose
• Scrape, copy, or redistribute Platform data without written permission
• Impersonate another person or entity
• Post content that is obscene, defamatory, or infringes on intellectual property rights

CastBank is a production and casting engine designed to bring the entertainment community together. We are not an employer, talent agency, or casting agency. CastBank does not promise, guarantee, or imply any offer of employment, auditions, bookings, or income to any user of the Platform. All casting and hiring decisions are made solely by the producers and casting directors using the Platform, and CastBank has no involvement in or responsibility for those decisions.

Submitting an application, creating a profile, or receiving a message through CastBank does not constitute an offer of employment or a guarantee of work. Users are encouraged to independently verify the legitimacy of any opportunity posted on the Platform.

Producers are solely responsible for compliance with applicable labor laws, union agreements (SAG-AFTRA, IATSE, etc.), and employment regulations when hiring through the Platform.

CastBank provides voucher generation tools as a convenience feature. Vouchers generated through the Platform are not legally binding contracts and do not constitute an offer of employment. All payment terms must be agreed upon directly between producers and talent/crew.

Booking deposits processed through the Platform are subject to Stripe's terms of service. CastBank is not responsible for disputes between producers and talent/crew regarding payment.

Your use of CastBank is governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect and process personal data as described in our Privacy Policy, including profile information, usage data, and payment information.

The CastBank name, logo, platform design, and all associated intellectual property are owned by CastBank. You may not use our trademarks, logos, or branding without prior written consent. The Platform's code, design, and functionality are protected by copyright law.

CastBank is provided "as is" without warranties of any kind. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. To the maximum extent permitted by law, CastBank shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or at our sole discretion with reasonable notice. Upon termination, your right to use the Platform ceases immediately. You may delete your account at any time from your account settings.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Los Angeles County, California.
